These terms and conditions outline the rules and regulations for the use of MyGuestSpot.com, owned and operated by My Guest Spot, LLC a Florida registered Limited Liability Company.

By accessing this website you accept and agree to these terms and conditions in full. Do not continue to use MyGuestSpot.com if you do not accept all of the terms and conditions stated on this page.

The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and any or all Agreements: "Client", "You" and "Your" refers to you, the person accessing this website and accepting the Company's terms and conditions. "The Company", "Ourselves", "We", "Our" and "Us", refers to our Company. "Party", "Parties", or "Us", refers to both the Client and ourselves, or either the Client or ourselves. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner, whether by formal meetings of a fixed duration, or any other means, for the express purpose of meeting the Client's needs in respect of provision of the Company's stated services/products, in accordance with and subject to, prevailing law of United States. Any use of the above terminology or other words in the singular, plural, capitalisation and/or he/she or they, are taken as interchangeable and therefore as referring to same.

We employ the use of cookies. By using MyGuestSpot.com you consent to the use of cookies in accordance with My Guest Spot's privacy policy.

Most of the modern day interactive web sites use cookies to enable us to retrieve user details for each visit. Cookies are used in some areas of our site to enable the functionality of this area and ease of use for those people visiting. Some of our affiliate / advertising partners may also use cookies.

Unless otherwise stated, My Guest Spot LLC and/or it's licensors own the intellectual property rights for all material on MyGuesSpot.com. All intellectual property rights are reserved. You may view and/or print pages from http://www.myguestspot.com for your own personal use subject to restrictions set in these terms and conditions.

User Accounts

Accounts created on MyGuestSpot.com are provided at the sole discretion of My Guest Spot LLC. Any data entered into our system will become the property of My Guest Spot LLC

Subscriptions are required to be paid in full at the beginning of each subscription period. Accounts that have not renewed prior to their expiration date will automatically be locked. Locked accounts will not be able to access the administration tools until the account is brought current, and users will receive a message stating that there is a problem with the account, and instruct them to contact the account holder. Residents will still be able to reqeust permits during this lockout period, however monitors will not be able to verify permits until the account is brought current.

Added properties have an unlimited free setup period, plus receive an additional 30 day free trial period to commence upon initial activation of the property. The setup period is defined as the period beginning when the property is added to your account, and ending when the property status is first activated (set to Active in the property settings). All properties shall become billable 30 days after their initial activation, and will remain billable while attached to your account, regardless of whether the property remains Active (online) or is reverted to Inactive (offline) status. Added units which become billable during a subscription period shall be prorated for the number of days remaining in the subscription period, and added to your next subscription renewal total.

Residents at properties in our system may register for a Resident Portal Account, which will allow them to view resident and guest vehicle registrations associated with their unit, and if permitted by the property, maintain their own vehicle registration records. By creating a resident portal account, you certify that you are the current resident of the property, and are legally authorized to view and make changes to your account. By using the Resident Portal, you agree to keep your information current, and accept any and all liability which may arise from your use of the tools or the information contained or not contained therein.

Hyperlinking to our Content

  1. The following organizations may link to our Web site without prior written approval:
    1. Government agencies;
    2. Search engines;
    3. News organizations;
    4. Online directory distributors when they list us in the directory may link to our Web site in the same manner as they hyperlink to the Web sites of other listed businesses; and
    5. Systemwide Accredited Businesses except soliciting non-profit organizations, charity shopping malls, and charity fundraising groups which may not hyperlink to our Web site.
  1. We will approve link requests from these organizations if we determine that: (a) the link would not reflect unfavorably on us or our accredited businesses (for example, trade associations or other organizations representing inherently suspect types of business, such as work-at-home opportunities, shall not be allowed to link); (b)the organization does not have an unsatisfactory record with us; (c) the benefit to us from the visibility associated with the hyperlink outweighs the absence of My Guest Spot LLC; and (d) where the link is in the context of general resource information or is otherwise consistent with editorial content in a newsletter or similar product furthering the mission of the organization.

No use of My Guest Spot LLC's logo or other artwork will be allowed for linking absent a trademark license agreement.

We reserve the right at any time and in its sole discretion to request that you remove all links or any particular link to our Web site. Removal of links from our website

If you find any link on our Web site or any linked web site objectionable for any reason, you may contact us about this. We will consider requests to remove links but will have no obligation to do so or to respond directly to you.

Whilst we endeavour to ensure that the information on this website is correct, we do not warrant its completeness or accuracy; nor do we commit to ensuring that the website remains available or that the material on the website is kept up to date.

Parking Compliance and Enforcement

By using the MyGuestSpot.com software, user agrees to comply with all parking rules and regulations at the property for which a permit has been issued. Failure to comply with the property's rules and regulations may result in the removal of the vehicle from the property. MyGuestSpot.com does not provide, contract for, or otherwise engage in any type of parking enforcement (such as issuing warnings, booting, or towing vehicles), and is not responsible for any enforcement action taken, whether valid or invalid.

If a property requires a fee for guest parking, that fee will be collected at checkout before the permit will be issued. All sales are final, and Pay2Park fees are non-refundable. If you have an issue with a Pay2Park permit, contact the property manager to request any changes to the permit, do not cancel the permit and request a new permit or you will be required to pay the parking fee a second time.

In the event a vehicle is removed from a property by the parking enforcement company contracted by that property's management company, the first thing to do is to call your local police department. Tow companies are required by law to report any vehicle involuntarily removed from a property. The police can give you the name and contact information for the tow company. Impound companies may charge additional storage fees if the vehicle remains in their possession over a specified period of time (varies from state to state) so it is imperative that you retrieve your vehicle as soon as possible. Once you have retrieved your vehicle, you may then dispute the action with your property management company.

User acknolwedges that any disputes or legal claims which may arise from an enforcement action are solely between the owner of the vehicle and the company or individuals who initiated the action. User further agrees to hold MyGuestSpot.com harmless for any damages or other claims which may arise as a result of an enforcement action by any third party regardless of whether that enforcement action was based on information contained within MyGuestSpot.com's permit database.

Liability

This website and it's content is provided "as is" and we make no guarantees that they always will be safe, secure, or error-free, or that they will function without disruptions, delays, or imperfections. To the extent permitted by law, we also DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not control or direct what content users add to our system, and we are not responsible for their actions or conduct (whether online or offline) or any content they share (including offensive, inappropriate, obscene, unlawful, and other objectionable content). We cannot predict when issues might arise with our site. Our aggregate liability arising out of or relating to these Terms or MyGuestSpot Products will not exceed the greater of $100 or an amount equal to the unused portion of your pre-paid subscription period.

To the maximum extent permitted by applicable law, we exclude all representations, warranties and conditions relating to our website and the use of this website (including, without limitation, any warranties implied by law in respect of satisfactory quality, fitness for purpose and/or the use of reasonable care and skill). Nothing in this disclaimer will:

  1. limit or exclude our or your liability for fraud or fraudulent misrepresentation;
  2. limit any of our or your liabilities in any way that is not permitted under applicable law; or
  3. exclude any of our or your liabilities that may not be excluded under applicable law.

The limitations and exclusions of liability set out in this Section and elsewhere in this disclaimer: (a) are subject to the preceding paragraph; and (b) govern all liabilities arising under the disclaimer or in relation to the subject matter of this disclaimer, including liabilities arising in contract, in tort (including negligence) and for breach of statutory duty.

Disputes

For any claim, cause of action, or dispute you have against us that arises out of or relates to these Terms or the MyGuestSpot.com website ("claim"), you agree that it will be resolved exclusively in the courts of the 17th Judicial Circuit, Broward County, Florida. You also agree to submit to the personal jurisdiction of either of these courts for the purpose of litigating any such claim, and that the laws of the State of Florida will govern these Terms and any claim, without regard to conflict of law provisions.
